Mediation practice in the first half of 2015
In January-June 2015 mediators of the Center, that are included in list of recommended mediators, held 51 mediations among which 31 – mediations in court, 20 – extrajudicial mediations.
Mediations were carried out on the following categories of disputes:
- 17 commercial mediations (rent relations, corporate between shareholders, mutual settlement between individual entrepreneurs, relations between customers, contractors and supervision at construction of the facility, and others).
- 14 mediations in family disputes (the division of property between the spouses, the determination of the residence and/or order of education of children);
- 13 mediations in labor disputes (wages, reinstatement, changing employment records);
- 2 mediations in consumer protection;
- 2 mediations in disputes between relatives on an apportionment of a share and removal of obstacles in use of premises;
- 3 mediations were about inheritance, collection of debt and neighbourship.
76% mediations have been concluded with signing of the mediation agreement. The highest level of success are commercial mediations – 94%. Then family mediations – 77% and labor – 62%. Average term for conflict resolution – 3-4 hours. And it should be noted that all commercial mediations were extrajudicial.
Analyzing results of the work it is important to consider such rate like feasibility of mediation agreement. 63% of signed mediation agreements have already executed today, others are in process of execution.
